SPORTS EVENT: WAIVER AND RELEASE OF LIABILITY

NOTICE: PARTICIPATION CONSTITUTES ACCEPTANCE

PLEASE READ CAREFULLY. By registering for, entering the venue of, or taking part in any way in the wild swimming activations and tours organized by Harakati International LLC ("Company") in and around Muscat, Oman, you ("Participant") acknowledge that you have read, understood, and irrevocably agree to be bound by the following terms and conditions, whether or not you sign a physical copy of this document. Participation itself constitutes full and binding acceptance of this waiver.

1. Assumption of Risks: Participant acknowledges that sports events involve inherent risks, including but not limited to injury or exposure to unpredictable conditions, animal life, and weather-related hazards. Participant voluntarily assumes all risks associated with participation in such activities.

2. Health and Fitness: Participant certifies that they are physically fit and capable of participating in sports events. It is the Participant's sole responsibility to consult a medical professional and obtain any necessary medical clearance before participating in any activity organized by the Company.

3. Release and Waiver: In consideration of being permitted to participate, Participant hereby releases, waives, discharges, and covenants not to sue the Company, its directors, officers, employees, agents, and affiliated entities from any and all liability, claims, demands, actions, or losses for personal injury, property damage, or wrongful death that may arise out of or occur during participation in any Company activities.

4. Indemnification: Participant agrees to indemnify and hold harmless the Company and its representatives from any liability, loss, damage, or costs (including attorney's fees) incurred as a result of the Participant's actions, negligence, or misconduct during the sports events and activities organized by the Company.

5. Consent to Photography, Videography, and Media Use: Participant acknowledges that photographs, video recordings, audio recordings, and aerial/drone footage ("Media") may be captured by the Company, its representatives, contractors, partners, and sponsors before, during, and after the event, and that participation in the event constitutes full and irrevocable consent to such capture.

Participant grants to the Company, and its affiliated entities, partners, and sponsors, a perpetual, worldwide, royalty-free, irrevocable, and transferable right and license to use, reproduce, edit, publish, distribute, and display the Media, in whole or in part, in any format or medium now known or hereafter developed, including print, digital, social media, broadcast, and promotional materials, for the purpose of marketing, advertising, and promoting future events and activities. Participant is not entitled to inspect, approve, or receive compensation for such use, and releases the Company, its partners, and sponsors from any related claims, including defamation, invasion of privacy, or infringement of moral or publicity rights.

6. Participation of Minors: Participants under the age of 18 may only take part with the prior consent of, and accompaniment or written authorization by, a parent or legal guardian, who by permitting the minor's participation accepts this waiver in full on the minor's behalf, including the release, indemnification, and media consent provisions above.

7. Limitation of Waiver: Nothing in this waiver shall be construed to exclude or limit liability for death or personal injury caused by the gross negligence or willful misconduct of the Company, its directors, officers, employees, or agents, to the extent such exclusion is prohibited under the laws of the Sultanate of Oman.

8. Governing Law and Jurisdiction: This waiver and release of liability shall be governed by and construed in accordance with the laws of the Sultanate of Oman. Any legal disputes arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the Muscat District courts.

9. Severability: If any provision of this waiver and release of liability is held to be invalid, illegal, or unenforceable, such invalidity, illegality, or unenforceability shall not affect the remaining provisions, which shall continue in full force and effect.

By taking part in this event in any capacity, you confirm your acceptance of all terms set out above.
